Welcome to Creative Stalker (“Company,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of CreativeStalker.com, our mobile apps, and any associated services (collectively, the “Platform”).

By accessing or using the Platform, you agree to these Terms.
If you do not agree, please discontinue use immediately.

1. Eligibility

To use Creative Stalker, you must:

• Be at least 13 years old (or the minimum age of digital consent in your country)
• Have legal capacity to enter into this agreement
• Not be prohibited from using online services under applicable law
• Agree to these Terms and our Privacy Policy

If you are using the Platform on behalf of a business or organization, you represent that you have the authority to do so.

2. Account Registration

You may need an account to access certain features. When you register, you must provide accurate information and keep it updated.

You are responsible for:

• Maintaining the confidentiality of your account and password
• All activity under your account
• Immediately notifying us of unauthorized use

We reserve the right to suspend or delete accounts that violate these Terms.

By posting content on the Platform, you grant Creative Stalker a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to:

• Host, store, display, reproduce, modify, distribute, and create derivative works
• Promote the Platform or your content
• Make content available to other users consistent with your settings

This license ends when you delete your content or your account, except:

• Backup copies may persist temporarily
• Content shared publicly may remain visible

3.3 Your Responsibilities

You agree that your content must not:

• Violate copyright, trademarks, or intellectual property
• Include harmful, illegal, hateful, or defamatory material
• Contain nudity or explicit content unless allowed under Platform guidelines
• Promote violence, harassment, or exploitation
• Include personal information of others without consent

You are responsible for obtaining any necessary permissions to upload content.

4. Prohibited Conduct

You may not use Creative Stalker to:

• Break any laws
• Upload malicious code, viruses, or harmful software
• Engage in harassment, bullying, stalking, or threats
• Scrape or collect data without permission
• Access private areas of the Platform
• Impersonate others or misrepresent affiliations
• Sell or commercially exploit the Platform without authorization
• Use bots, automation tools, or fake accounts
• Interfere with Platform operations or security

We reserve the right to investigate violations and take action including warnings, content removal, account suspension, or reporting to authorities.

5. Content Moderation

We may remove or restrict content that violates:

• These Terms
• Our Privacy Policy
• Community Guidelines
• Applicable laws
• Intellectual property rights

We may also suspend or terminate accounts for repeated or severe violations.

We do not guarantee that all content will be monitored or removed.
Users engage with the Platform at their own risk.

6. Intellectual Property

The Platform, its design, features, software, trademarks, and branding are owned by Creative Stalker or licensed to us.

You agree not to:

• Reproduce, modify, reverse engineer, or distribute the Platform
• Use our trademarks without authorization

All rights not expressly granted are reserved.

7. Payments, Purchases & Subscriptions

Certain features may require payment or subscription.

By making a purchase, you agree to:

• Provide accurate billing information
• Pay all listed fees and taxes
• Allow us or our payment processors to charge your payment method

Paid features may be governed by additional terms.

We may change pricing with notice as required by law.

8. Third-Party Services

Creative Stalker may integrate with or link to third-party services.
We are not responsible for:

• Their content
• Their privacy practices
• Their terms or policies

Your interactions with third parties are solely between you and the third party.

9. Termination

We may suspend or terminate your account at our discretion, including for:

• Violating these Terms
• Illegal or harmful activity
• Extended periods of inactivity
• Requests from legal authorities

You may delete your account at any time.

Upon termination:

• Your right to use the Platform ends
• We may retain archived copies as required by law
• Public-facing content may remain available

10. Disclaimers

Creative Stalker is provided “as is” and “as available” without warranties of any kind, including:

• Accuracy
• Reliability
• Availability
• Security
• Non-infringement

We do not guarantee uninterrupted or error-free operation.

You use the Platform at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law:

• Creative Stalker is not liable for indirect, incidental, special, punitive, or consequential damages, including loss of data, profits, or access.
• Our total liability is limited to the greater of $50 or the amount you paid us in the past 12 months.

Some jurisdictions do not allow certain limitations—those laws apply accordingly.

12. Indemnification

You agree to indemnify and hold Creative Stalker harmless from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Platform
• Your content
• Your violation of these Terms
• Your violation of rights of any third party

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflicts of law.

All disputes will be resolved through:

1. Good-faith negotiation
2. If unresolved, binding arbitration in Miami-Dade County, Florida

You waive the right to participate in class actions.

14. Changes to These Terms

We may update these Terms from time to time.
Changes become effective when posted on the Platform.

Your continued use constitutes acceptance of updated Terms.
